The Haryana Government has drafted a ‘Transparent Inspection Scheme’, which is aimed at regulating the implementation of statutory provisions under various labour laws in a transparent and accountable manner through wide-scale adoption of technology and innovation. The draft scheme has been made available on the Haryana Labour Department’s website hrylabour.gov.in and invited feedback from stakeholders and the public by January 10, 2016.
While giving this information here today, Haryana Labour and Employment Minister, Capt. Abhimanyu said that the scheme would not only simplify the business regulations, but would also protect the rights of workers in relation to their safety, health welfare and other conditions of employment in letter and spirit as envisaged under the law. He added that the stakeholders might send their comments or suggestions regarding the scheme to the Labour Commissioner, Haryana, by post or through e-mail at selfcertificationhry@gmail.com.
Giving further details, Capt. Abhimanyu said that the Labour Department implements various provisions related to safety, health, welfare and other conditions of employment under various labour laws, and has notified various functionaries for the inspection of establishments and factories in order to ensure the compliance of various provisions under these laws.
He added that though inspection guidelines have been framed in the past, these have not been implemented properly and there have been some complaints of adhocism in the inspections. Apart from this, the prevalent instructions and guidelines do not conform to the use of Information Technology, which has to be brought to the fore in the near future, he added. Therefore, a new comprehensive transparent inspection policy is required to be put in place to achieve the objective of simplifying business regulations and to regulate the implementation of statutory provisions under various labour laws in transparent and accountable manner through wide scale adoption of technology and innovation. Also, the policy is required to protect the rights of workers in relation to their Safety, Health and Welfare as other conditions of employment in the spirit and manner as envisaged in the law. The policy aims at eliminating the arbitrariness and adhocism in the actions of inspecting authorities as also to curb the malpractices and harassment of the industrial and other establishments with a view to improve the ease of doing business.
He said that the inspections would be conducted only by a team of inspecting officers or officials and no inspections would be conducted by any individual officer. The team for the inspection of the units would be constituted by the computerized system. He said that the senior most officer of the inspecting team would give 15-days prior notice of inspection indicating the team members with a copy to the head office on the prescribed format along with the checklist for inspection.
In case of serious accident, the enquiry would be conducted by concerned Assistant Director, Industrial Safety and Health. In case of fatal accident, the enquiry would be conducted by the concerned Deputy Director, Industrial Safety and Health. These officers might take assistance of any other official or officer. The enquiry reports would be sent to head office within 72 hours of completion of enquiry, he added.
