DSE teachers transfer policy approved

CHANDIGARH, JUNE 28
The Haryana Cabinet approved the Teachers Transfer Policy for the Department of School Education after making certain amendments in the earlier draft of the policy. The earlier draft of the policy was approved by the Cabinet and notified on April 30,2016. But later, some suggestions came from various stakeholders. After considering these suggestions, a new amended draft was prepared.
          The Policy seeks to ensure equitable choice based deployment of teachers and School Heads in a fair and transparent manner and protects the academic interest of the students.
          The Transfer Policy has time schedule of all activities. Some ‘Serious Ailment Diseases’ have been redefined as ‘Diseases of Debilitating Disorder’. There is a provision of considering ‘Lowest of the Two’ pass percentages of class X and XII which have been revised as ‘Average of the Two’. The category ‘Wife of Haryana Government Employees’ has been excluded from the list of ‘Special Category Female Teachers’. The word ‘Men’ has been included in the category ‘Differently abled or mentally challenged children’.
          The vacancies have been redefined as ‘Actual Vacancy’ and ‘Deemed Vacancy’. The provision made about adjusting the teachers returning from leaves has been dropped. As a one-time measure, all teachers irrespective of their stay have been made eligible to seek transfer in the current year. Provision to associate NCC officers has been provided by amending the relevant Para to the extent that Associate NCC Officers (ANO) will be replaced by teachers working as associate NCC Officers only.
          The period of implementation of transfer has been extended from seven days to 15 days. General transfers will be made only once in a year as per the time scheduled already mentioned or as notified by the government for a given year. However, transfers can be effected at any time during the year in a case of administrative exigency, transfer of spouses of employees of departments or organisations of State and Central Governments and on compassionate grounds other than those under Para 6(iii)(b) of the unrevised policy. The reason for transfers under these grounds shall be recorded on file.
          In case of criteria for deciding the claim against vacancy, in special category, the sub factor will include widow or divorced or separated unmarried female teacher more than 40 years of age or wife of serving military personal or paramilitary personal working outside the State. In case of ‘Disease of Debilitating Disorders’, the sub factor will include spouse or unmarried children. In this case, the criteria would also include a certificate issued by AIIMS, including its branches in Haryana, PGI Rohtak, PGI Khanpur Kalan, Kalpana Chawla Medical College, Karnal, PGI Chandigarh or duly constituted Medical Board only. Similarly, in case of Differently abled or mentally challenged children, the sub factor will be men or women having mentally challenged or 100 per cent differently abled child. The men or women teachers having mentally challenged or 100 per cent differently abled children shall be provided maximum 10 points.
          In case of teachers teaching both X and XII classes, average of the two pass percentages will be taken for calculation of the privilege points.
          The vacant post has been defined as a post not occupied by any teacher, a post which will become vacant due to retirement, promotion, voluntary retirement or otherwise as on date of publication of vacancies as per the schedule. Some vacancies of all categories of teachers will remain unfilled at any given point of time. To avoid their concentration in some schools, percentage of such vacancies shall be maintained proportionately amongst all schools, except the posts of heads of institutions.
          Minimum stay for seeking transfer shall be three years. However, for the first time, all teachers irrespective of their stay shall be entitled to give their choices for transfer, if they desire so.
          All transfers shall be implemented within 15 days of their issuance. The copy of transfer orders shall be sent to the Treasury Officer concerned with a request not to draw the salary of such transferred teacher from the institution he or she has been transferred.
