Haryana Cabinet approves increase retirement age of doctors

CHANDIGARH, NOV 15
 Haryana Cabinet, which met under the Chairmanship of Chief Minister Mr Manohar Lal here today, approved the recommendations of the Committee of Officers headed by Chief Secretary to increase the retirement age of doctors of the Health Department. The Cabinet approved the policy decision to give an offer to the doctors, who have retired from Haryana Civil Medical Service (HCMS) and are below 65 years of age to get re-employed on the principle of last pay drawn minus pension for discharging only clinical duties in a hospital of their choice. Only those doctors, who are below 65 years of age and have at least one year remaining to attain 65 years on the date of filing application will be eligible for re-employment, if they so desire. They may indicate three hospitals in the orders of priority, where they would like to get posted for performing clinical duties against vacancy of any level.
          Their pay would be notionally fixed in the revised pay scales after January 1,2016 and on that basis, their revised pension would be deducted from the revised pay and the remaining would be given to them as the salary. They would also get the benefit of DA as announced by the government from time to time. It would be admissible towards pension and revised salary. The Non Practicing Allowance will also be admissible on the revised pay.
          On re-employment, they would be suitably re-designated such as Medical Consultants, Senior Consultants and Consultant Specialists, depending upon the educational degree one possesses. Those doctors, who are still in service, their retirement age would be increased from 58 years at present to 65 years for performing only clinical duties. On attaining the age of 58 years, they will cease to hold administrative posts of Deputy Chief Medical Officer, Chief Medical Officer, Director, Additional Director General, Director General or any other equivalent post. During the extended period beyond 58 years, they will be assigned only clinical duties at a hospital of their choice.
          Two months prior to attaining the age of 58 years, they will be asked to apply for extension beyond 58 years and also indicate three hospitals of their choice in the order of preference for working in clinical capacity. The condition of two months will be applicable with effect from February 1,2017. The doctors retiring on December 31 and January 31 may apply within three weeks of coming into force of this policy and the doctors retiring on November 30,2016, may apply immediately on coming into force of this policy. The condition of two months would be relaxed by the government for justifiable reasons.
          During the period beyond 58 years, the doctors will continue to be governed by the Conduct Rules as well as Haryana Civil Services (Punishment and Appeal) Rules. The service beyond the age of 58 years will be continued towards qualifying service for ACP, increments and other benefits if applicable.
          The facility of re-employment on last pay drawn minus pension principle would be applicable only on those doctors who have retired prior to coming into force of this policy. After implementation of this policy, if a doctor does not wish to perform clinical duties and seeks voluntary retirement, he or she will not have the option to come back for re-employment later on.
          In case a doctor does not wish to work in clinical capacity upon attaining the age of 58 years, he or she will have the option to seek voluntarily retirement at the age of 58 years with full pension.
          In case a doctor expresses desire to continue beyond 58 years for performing clinical duties, their application will be examined by the office along with their service record and conduct of last ten years. Extension beyond 58 years will be granted only if the service record of these years has been satisfactory, no charge sheet for major penalty is pending and integrity has never been doubtful. However, if a charge sheet for a major penalty is pending, the extension in service may be granted subject to outcome of the pending disciplinary proceedings.
          The performance of doctors beyond 58 years, as recorded in the appropriate proforma, will be forwarded by the institutional head to the office of Director General on periodic basis as on the basis of which their annual confidential report will be written. In the event of poor performance being reported repeatedly or on a charge of serious misconduct, the normal Haryana Civil Services (Punishment and Appeal) Rules will be applicable and action per law has been taken.
